This teenager has offers from three Australian universities but can’t accept any – By Sean Wales<\/span><\/strong><\/span><\/h2>\n

As young people in Australia anxiously wait for offers to study at university, one talented student doesn’t have the same opportunities as her peers.<\/strong><\/span><\/p>\n

For Iranian refugee Helia Diba, watching her friends chase their goals is bittersweet.<\/span><\/p>\n<\/div>\n

\n

The 19-year-old graduated from high school last year, and despite receiving three university offers to study architecture and business, she was unable to accept any of them.<\/span><\/p>\n<\/div>\n

\u201cIt was really exciting but sadly I had to defer all of my courses, just hoping by then I would have a visa and study rights to be able to attend,\u201d she said.<\/span><\/div>\n<\/div>\n<\/div>\n

Helia and her family have lived in Australia for more than three years, but they can\u2019t work or study. They left their homeland to seek asylum in Australia nine years ago and are living in the community under what the Australian government describes as Residence Determination.<\/span><\/p>\n<\/div>\n

In other words, they\u2019re in community detention and their visa status doesn’t allow Helia to be able to attend university.<\/span><\/div>\n<\/div>\n

It also means her father can\u2019t utilise his skills as a mechanical engineer, and her mother and sister can\u2019t earn any money as artists.<\/span><\/p>\n<\/div>\n

\n

Helia describes it as being stuck in limbo.<\/span><\/p>\n<\/div>\n

\n

\u201cI watch all of my other friends, including friends who are refugees, getting on with their lives and I\u2019m just stuck,\u201d she said.<\/span><\/p>\n<\/div>\n

\u201cYou\u2019re forced to stay home, there\u2019s no options. It\u2019s like you can see all the opportunities in this country and not being able to use any of them.\u201d<\/span><\/div>\n

A decade of uncertainty<\/span><\/h3>\n<\/div>\n
\n

Helia says her family is in the community detention program because of the mode of transport they used to come to Australia.<\/span><\/p>\n<\/div>\n

\n

After fleeing Iran due to fears of religious persecution in 2013, they took a boat from Indonesia, before being taken to Christmas Island.<\/span><\/p>\n<\/div>\n

In 2013, the then-Rudd Labor government set a policy that means people who arrive in Australia by boat are not allowed to permanently settle here. Both major parties support the policy.<\/span><\/div>\n<\/div>\n<\/div>\n

Helia’s family were placed in detention on Nauru, where they would stay for five years before coming to Australia under the Medevac Bill laws in 2018.<\/span><\/p>\n<\/div>\n

\n

\u201cWe were told we would be in Nauru for six months and then we\u2019d be granted a visa for Australia,\u201d she said.<\/span><\/p>\n<\/div>\n

\n

\u201cInstead, we lived in a tent for about a year before we moved into the Nauru community. We lived there for five years.\u201d<\/span><\/p>\n<\/div>\n

Helia and her family were granted refugee status while in Nauru and despite now being in Australia, she said they have similar rights to when they were in offshore detention.<\/span><\/div>\n<\/div>\n<\/div>\n

They live in a government-paid home in Melbourne\u2019s northern suburbs, and her parents receive around $120 each a week from Centrelink.<\/span><\/p>\n<\/div>\n

\n

\u201cIt\u2019s not enough, especially with the prices of everything going up right now. It\u2019s enough for food and sometimes there are other programs that help us out,\u201d she said.<\/span><\/p>\n<\/div>\n

\n

She said their life in Australia is a far cry from the hopes and dreams they had for their new lives when they left Iran almost a decade ago.<\/span><\/p>\n<\/div>\n

\u201cWhen we left my dad told me Australia would provide an opportunity to go to university, have my own life, move out of home, and there would be safety,\u201d she said.<\/span><\/div>\n
\n

Hundreds in the same position<\/strong><\/span><\/h3>\n<\/div>\n
\n

The latest data from the Department of Home Affairs shows as of 30 June this year, 566 people were living in Australia under the community detention program.<\/span><\/p>\n<\/div>\n

More than three-quarters of them had been in the program for more than 1,096 days.<\/span><\/div>\n

Saba Vasefi is an Iranian Australian scholar and journalist at the University of Sydney and has spoken to multiple young people living in community detention.<\/span><\/p>\n<\/div>\n

\n

She said they are being punished because they arrived in Australia by boat.<\/span><\/p>\n<\/div>\n

\n

“These youth did not have any power over their mode of arrival, yet Australia is vigorously punishing them.<\/span><\/p>\n<\/div>\n

“This is a punitive strategy. It is not a replacement for a visa. It has no value other than punitive violence and isolation.”<\/span><\/div>\n<\/div>\n

Saba Vasefi, Academic<\/cite><\/span><\/p><\/blockquote>\n<\/div>\n

\n

Ms Vasefi is calling on the federal government to consider the cases of young people living in Australia in community detention as a matter of priority.<\/span><\/p>\n<\/div>\n

\n

“This needs to be repealed – the government should act urgently to facilitate access to tertiary education for these refugees, and offer them specific scholarships,” she said.<\/span><\/p>\n<\/div>\n

“I think both sides of politics are very lazy in relation to addressing humanity issues on a global and national scale.”<\/span><\/div>\n
\n

‘We don’t have anything to look forward to’<\/span><\/h3>\n<\/div>\n
\n

Helia\u2019s message to the government is to abolish the program altogether.<\/span><\/p>\n<\/div>\n

\n

\u201cThis policy is inhumane. No human being deserves to be treated this way and have to live in this situation,\u201d she said.<\/span><\/p>\n<\/div>\n

\n

\u201cWe don\u2019t really have an option to apply for any visa, except for a bridging visa. You can work on that but again you don\u2019t have the rights to study. I don\u2019t want my life to just be working; I want to study.”<\/span><\/p>\n<\/div>\n

\n

But she is not hopeful that will happen and her family is now looking overseas for other opportunities.<\/span><\/p>\n<\/div>\n

\n

\u201cThe government will never change the policy on this. All the refugees that came to Australia by boat will never be resettled here in Australia,\u201d she said.<\/span><\/p>\n<\/div>\n

\n

\u201cMy family has shown interest in resettlement to New Zealand and right now we are just looking forward to that.<\/span><\/p>\n<\/div>\n

\u201cThe future is all blurry, we don\u2019t have anything to look forward to.\u201d<\/span><\/div>\n

In a statement provided to SBS News, a spokesperson for the Department of Home Affairs said the department “will continue to work with the government on a range of measures aimed at addressing barriers to status resolution and associated risks of long-term detention”.<\/span><\/p>\n<\/div>\n

\n

Minister for Immigration, Citizenship and Multicultural Affairs, Andrew Giles, “has expressed the government\u2019s commitment to humane and risk-based immigration detention policies”, they said.<\/span><\/p>\n<\/div>\n

\n

The spokesperson said individuals in community detention are provided with health services, accommodation, case worker support and a living allowance, but must comply with conditions including that those over the age of 18 do not engage in study.<\/span><\/p>\n<\/div>\n
