Sri Lankan cricketer Danushka Gunathilaka says he is looking forward to resuming his playing career after a Sydney judge acquitted him of sexual assault facing\u00a0a judge-alone trial in the Downing Centre District Court,<\/strong>\u00a0Mr Gunathilaka was on Thursday found not guilty of one count of sexual intercourse without consent relating to an allegation that he had removed a condom without a woman\u2019s knowledge during sex<\/strong>.<\/strong><\/span><\/p>\n

After pleading not guilty, he did not react as Judge Sarah Huggett read out her verdict, and he hugged and kissed a woman who has supported him throughout the trial. \u201cI think the judge\u2019s verdict says everything,\u201d he said outside court, thanking his family, lawyers, manager and supporters. He added: \u201cThe last 11 months have been really hard for me \u2026 I\u2019m happy that my life is normal again. So, I can\u2019t wait to go back and play cricket.\u201d<\/span><\/p>\n

Judge Huggett heard four days of evidence, including from the complainant who said the cricketer was \u201cforceful\u201d and \u201caggressive\u201d during consensual sex at her unit in Sydney\u2019s eastern suburbs. She said during her judgment on Thursday there was \u201cno opportunity\u201d to remove the condom \u201cbecause that intercourse was continuous\u201d.<\/span><\/p>\n

Judge Huggett described the complainant as an \u201cintelligent\u201d and \u201ccalm and responsive\u201d witness. \u201cShe did not strike me as a witness motivated by a desire to give deliberately false evidence,\u201d Judge Huggett said. \u201cHowever, there were occasions when I formed the impression that some of her evidence had the appearance of being motivated by a desire to paint the accused in an unfavourable light.\u201d<\/span><\/p>\n

The 32-year-old batsman met up with the woman at Sydney\u2019s Opera Bar on November 2 last year after matching on Tinder while Mr Gunathilaka was in Australia to play in the T20 World Cup<\/strong>. It was not in dispute the pair had chatted several times through Tinder, Instagram and video called on WhatsApp from October 31 before their meeting three days later.<\/span><\/p>\n

CCTV footage<\/strong>\u00a0played to the court\u00a0showed the pair hugging as they met and kissing while waiting for a ferry back to the woman\u2019s home about 11pm<\/strong>. After playing guitar and kissing on the couch, the pair moved to the bedroom where the woman, who gave evidence via AVL, told the court she asked Mr Gunathilaka to use a condom but he allegedly said he \u201cdidn\u2019t like them\u201d.<\/span><\/p>\n

According to the woman\u2019s evidence, Mr Gunathilaka said: \u201cDon\u2019t worry I don\u2019t get you pregnant darling, don\u2019t you trust me?\u201d<\/span><\/p>\n

\u201cI remember him saying that he hated them, he said something like \u2018I hate using condoms, I don\u2019t like them, it doesn\u2019t feel good you should trust me\u2019,\u201d the woman told the court.<\/span><\/p>\n

During his interview with police days later, Mr Gunathilaka admitted he preferred to have sex without a condom, but denied saying he didn\u2019t want to use one with the woman. He said: \u201cI just said \u2018normally I don\u2019t like to have sex with condoms\u2019<\/strong>, I didn\u2019t say \u2018I don\u2019t want to have sex without a condom\u2019.\u201d<\/span><\/p>\n

Judge Huggett said the complainant did not give evidence about seeing him pause or throw the condom on the ground. \u201cShe said she saw what the accused\u2019s hands were doing during the intercourse and did not see him move his hands towards his penis, nor move his arm or hand as if throwing something to the floor,\u201d Judge Huggett said. She added it was \u201chardly surprising on any account a used condom was removed\u201d.<\/span><\/p>\n

Judge Huggett described aspects of the police\u2019s handling of the woman\u2019s complaint as \u201cdeeply troubling\u201d<\/strong>\u00a0\u201cAspects of the handling of her complaint were far from satisfactory and to be frank, very concerning,\u201d she said.\u00a0In particular said that notes taken by officers during the woman\u2019s first interview with police \u201cmake no record of an offence of stealthing\u201d. She also said that \u201cfor no good reason at all, those notes were destroyed.\u201d<\/strong><\/span><\/p>\n

The international cricketer\u2019s police interview, in which he becomes emotional when talking about religion, was\u2026<\/span><\/p>\n

Mr Gunathilaka was arrested in the early hours of November 6 at the Hyatt Regency and taken to Day Street Police Station where\u00a0he answered questions for more than two hours<\/strong>.\u00a0During his recorded interview, the cricketer became emotional as he spoke about a spiritual conversation he had with the alleged victim where she said she had the power to \u201csee the future\u201d. He told police he was \u201cinterested\u201d as he was a Buddhist. \u201cWe were talking about religious things \u2026 she can see in a past life and we chatted about that kind of stuff,\u201d he said in the interview as he broke down in tears.<\/span><\/p>\n

Gunathilaka told officers he asked the woman to tell him about his past life. He said she told him they used to be neighbours in Thailand.<\/strong><\/span><\/p>\n

The cricketer told police he became\u00a0scared and \u201cgot a feeling\u201d the woman was \u201ca bit weird\u201d, prompting him to leave. She ordered him a taxi.<\/span><\/p>\n

He was asked if at any point he put his penis \u201cinto her without a condom on\u201d.<\/span><\/p>\n

\u201cNo, no, definitely not,\u201d Mr Gunathilaka replied.<\/span><\/p>\n

After Mr Gunathilaka was found not guilty on Thursday, he is free to return to his hometown of Colombo in Sri Lanka. The court heard he will make an application to pay his legal costs. He will return to court on October 4 as he attempts to recoup his lawyer\u2019s fees.<\/span><\/p>\n
