color: #000000;\">But is that what Aboriginal people really want \u2014\u00a0for all Australians to have equal access to what has long been recognised as a symbol of Aboriginal power and resistance?<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">It has been celebrated as a win after a hard-fought campaign dubbed &#8220;Free the Flag&#8221;, spearheaded by Clothing the Gaps chief executive Laura Thompson.<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">The campaign called for the Aboriginal flag to be treated like every other officially recognised flag in the world, freeing it from licensing agreements and allowing Aboriginal people to have equal rights and access.<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">But now the ownership will lie with the Commonwealth \u2014 the same power that has eroded the rights and committed atrocities against Aboriginal people since 1788 \u2014 and that has left many people in the Indigenous community uneasy.<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">In a world where ownership is implicitly aligned with power, many Aboriginal people feel the flag should have been returned to the community as an act of empowerment.<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">Who gets to use the Aboriginal flag now?<\/span><\/h2>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">The flag represents Aboriginal people, their lives and their connection to land.<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">Allowing free use of the design raises some ethical questions about who should be allowed to profit from Aboriginal symbols.<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">Previously, Thomas decided who would be allowed to reproduce his design.<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">He gave licences to three companies: WAM Clothing, Gifts Mate and Flagworld, none of which are owned by Indigenous people.<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">Now the Prime Minister says the flag is free to be used by anyone without seeking permission or paying a fee, as long as it is presented in a &#8220;respectful and dignified way&#8221;.<\/span><\/p>\n<aside class=\"_2X-83 g1U-R _1VIKT\" data-component=\"Pullquote\">\n<blockquote class=\"_2Bzft\">\n<p class=\"_1HzXw\"><span style=\"font-size: 16px; color: #000000;\">&#8220;All Australians can now put the Aboriginal Flag on apparel such as sports jerseys and shirts. It can be painted on sports grounds, included on websites, in paintings and other artworks, used digitally and in any other medium without having to ask for permission or pay a fee,&#8221; his statement read.<\/span><\/p>\n<\/blockquote>\n<\/aside>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">But who decides what is considered &#8220;respectful and dignified&#8221;? Could someone sell Australia Day merchandise with the flag on it, a move that would horrify many Indigenous people?<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">That caveat has drawn the ire of some Aboriginal people, as it feels like the government is placing expectations over what Aboriginal people can and can&#8217;t do with their flag.<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">Flagworld will also still remain the exclusive licensed manufacturer and provider of Aboriginal flags and bunting.<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">The government says this is to &#8220;ensure the flags themselves are of the highest quality and continue to be manufactured in Australia&#8221;, but Flagworld is not stopping individuals from making their own flag for personal use.<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">While it&#8217;s a win that the flag is no longer exclusively being profited off by non-Indigenous companies, businesses like Clothing the Gaps \u2014 which employ mostly Indigenous staff and direct a portion of their profits to Indigenous charities and causes \u2014 could very well be undercut by an influx of Aboriginal flag-themed merchandise that is now able to be sold.<\/span><\/p>\n<h2 class=\"_3HiYf _2K_6X _1cBaI _2b-O4 _2yZBa _3I3Xh _2uBSR _10YQT _1lh6E\" style=\"text-align: center;\" data-component=\"Heading\"><span style=\"font-size: 20px; color: #000000;\">Symbol of Aboriginal rights now in government hands<\/span><\/h2>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">Indigenous Affairs Minister Ken Wyatt says the government taking ownership of the flag brings it into line with the Australian flag \u2014 known as &#8220;stars and crosses&#8221; \u2014 and it means no-one\u00a0can &#8220;restrict&#8221; use of the flag in the future, meaning it can be used to promote products and events.<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">Both are recognised as national flags of Australia, but while stars and crosses was selected as the winner of a Commonwealth design competition, the design for the Aboriginal flag was born during a turning point for Aboriginal rights in Australia.<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">Since the 1970s, it has flown at countless protests and movements \u2014 often against the government and government policies \u2014 and, when it comes to ownership of that symbol, it&#8217;s important to recognise its origins.<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">Warriors for Aboriginal Resistance spokesperson Meriki Onus says government ownership goes against fundamental Aboriginal rights principles.<\/span><\/p>\n<aside class=\"_2X-83 g1U-R _1VIKT\" data-component=\"Pullquote\">\n<blockquote class=\"_2Bzft\">\n<p class=\"_1HzXw\"><span style=\"font-size: 16px; color: #000000;\">&#8220;The reason the flag exists is to fight for Aboriginal sovereignty and for Aboriginal self-determination, and the fact that the federal government own it is really the antithesis to the reason the flag exists, in my opinion,&#8221; she said.<\/span><\/p>\n<\/blockquote>\n<\/aside>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">Ownership is a loaded term for Aboriginal people, whose lives have been defined by being denied ownership of their land and their children.<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">In many ways, the &#8220;freeing&#8221; of the Aboriginal flag can be read as a metaphor for the way the government engages with Aboriginal communities more broadly.<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">They ask to be listened to and empowered to act in their own best interests, but so often, their words aren&#8217;t heard, and bureaucrats hand down decisions that take away their agency and ultimately leave them worse off.<\/span><\/p>\n<p class=\"_1HzXw\" style=\"text-align: justify;\"><span style=\"font-size: 16px; color: #000000;\">By not turning over the flag to an Aboriginal-led body, the government is open to criticism that it&#8217;s acting with the same paternalism that has had a negative effect on the lives of Aboriginal people.<\/span><\/p>\n<figure id=\"attachment_85071\" aria-describedby=\"caption-attachment-85071\" style=\"width: 600px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" loading=\"lazy\" decoding=\"async\" class=\"wp-image-85071 size-full\" src=\"https:\/\/websitedesigns.com.au\/elankanew\/wp-content\/uploads\/2022\/01\/The-Commonwealth-bought-the-Aboriginal-flag-4-e1643170361263.png\" alt=\"The Commonwealth bought the Aboriginal flag\" width=\"600\" height=\"399\" \/><figcaption id=\"caption-attachment-85071\" class=\"wp-caption-text\"><span style=\"color: #000000; color: #000000;\">A government inquiry into the ownership, copyright and licensing of the Aboriginal flag was presented with a number of options \u2014 including a custodianship model or turning over ownership to an independent Aboriginal-led body \u2014 but it seems those recommendations have been largely ignored.<\/span><\/p>\n<p class=\"_1HzXw\"><span style=\"font-size: 16px; color: #000000;\">Djab Wurrung, Gunnai, and Gunditjmara woman and Greens Senator Lidia Thorpe sat on the committee.<\/span><\/p>\n<p class=\"_1HzXw\"><span style=\"font-size: 16px; color: #000000;\">She says the government was aware of better options for giving ownership of the flag back to Aboriginal people.<\/span><\/p>\n<p class=\"_1HzXw\"><span style=\"font-size: 16px; color: #000000;\">Senator Thorpe says\u00a0the Commonwealth holds the copyright to the flag and that means that there needs\u00a0to\u00a0be more conversations around how self-determination, from an Aboriginal perspective, is played out.<\/span><\/p>\n<aside class=\"_2X-83 g1U-R _1VIKT\" data-component=\"Pullquote\">\n<blockquote class=\"_2Bzft\">\n<p class=\"_1HzXw\"><span style=\"font-size: 16px; color: #000000;\">&#8220;Certainly, through the flag inquiry, there were many other options for the flag to go back to the people where it belongs,&#8221; she says.<\/span><\/p>\n<\/blockquote>\n<\/aside>\n<p class=\"_1HzXw\"><span style=\"font-size: 16px;
